Terms of Service

You must be at least 13 years old, and at least the age of majority in your jurisdiction to enter into a binding contract. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it to these Terms.

A HOFFUN account lets you post, generate, and remix. Connecting a self-custodied wallet additionally enables NFT verification, minting, and trading. You are responsible for safeguarding your credentials, seed phrase, and private keys. We cannot recover lost wallet access on your behalf.

You retain ownership of the content you submit (“User Content”). By submitting User Content you grant HOFFUN a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, adapt, display, and distribute it solely to operate, improve, and promote the Service. You represent that you have all rights necessary to grant this licence.

Generative features produce outputs based on your prompts and the underlying model. Outputs may be inaccurate, offensive, or unoriginal. You are responsible for reviewing outputs before publishing them and for complying with the terms of any third-party model provider. Generations are credit-metered; abuse, automation, or resale of credits is prohibited.

NFTs and on-chain transactions are executed by you on public blockchains. They are irreversible, settle in volatile assets, and carry risk including total loss. HOFFUN is not a broker, exchange, custodian, or financial adviser. Market data is provided for information only and is not a recommendation to transact.

You must not:

• · post unlawful, infringing, harassing, or sexually exploitative content;
• · impersonate any person or misrepresent provenance of work;
• · reverse engineer, scrape at scale, or interfere with the Service;
• · upload malware, phishing links, or wallet-draining contracts;
• · use the Service to wash-trade, market-manipulate, or evade sanctions.

We may remove content, disable features, or suspend accounts that we reasonably believe violate these Terms or applicable law. Where possible we will provide notice and a path to appeal. You may close your account at any time; certain on-chain records cannot be erased.

The Service, including its software, brand, and design, is owned by HOFFUN or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right in our marks beyond fair, descriptive use.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, HOFFUN shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from your use of the Service. Our aggregate liability for any claim shall not exceed the greater of the amounts you paid to HOFFUN in the twelve months preceding the claim or one hundred US dollars.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. Disputes shall be resolved in the courts of London, England, save where mandatory consumer protection law provides otherwise.

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
